Welcome to 时光星达 (Shiguang Xingda) (hereafter “the App”). These Terms of Service (“Terms”) form a binding agreement between you and the App’s developer (“we”, “us”) regarding your download, installation and use of the App. Please read these Terms carefully before using the App. By continuing to use the App, you agree to all of these Terms. If you do not agree, please do not download, install or use the App.

1. About the service

时光星达 is an iOS instant messaging and lifestyle recording application that includes:

Instant messaging: private chat, group chat, voice / video messages
Life recording: audio diary, photo stories, mood garden, time capsule letters, moment days
Explore & interact: daily challenges, fun calculator, ambient soundscape, daily quotes
Personal growth: Stardust point system, achievement collection

The instant messaging features rely on remote servers for message delivery; life-recording features store data locally on your device.

2. Account registration and use

You need to register with a phone number to use the core features of the App.
You are responsible for keeping your account credentials secure and must not lend, transfer or otherwise share your account with others.
You bear responsibility for security issues caused by your own actions.

3. License

We grant you a personal, non-exclusive, non-transferable, limited license to download, install and use the App on Apple devices that you own or control. Copyright, trademark and other intellectual property rights in the App belong to us or their respective owners.

Without our prior written consent you may not:

Copy, modify, adapt, translate, reverse engineer, decompile or disassemble any part of the App;
Sell, rent, lease, sublicense, transfer the App, or provide its functionality to a third party for a fee;
Remove, obscure or alter any copyright, trademark or other proprietary notices in the App;
Use the App to engage in any activity that violates the law or infringes the rights of others;
Interfere with or disrupt the App’s normal operation or attempt to bypass its access controls.

4. Acceptable use

You agree that:

You take full responsibility for how you use the App;
You will not use the App to send or distribute any unlawful, infringing, abusive, obscene, violent, fraudulent or otherwise inappropriate content;
You will not use the App to harass others, send spam, phish or commit fraud;
You will not collect or use other people’s personal information without their consent;
You are solely responsible for backing up your important data. Local feature data lives in the App’s sandbox and is deleted on uninstall.

If you violate any of the above we may restrict or terminate your access to the App without notice.

5. Intellectual property

All content of the App (including but not limited to source code, UI, icons, copy and graphics) is protected by copyright laws of the People’s Republic of China and international treaties. Except for the limited license expressly granted in these Terms, you may not reproduce, modify, redistribute or commercially exploit any of it without our prior written consent.

Content you create through the App (e.g. audio diaries, photo stories, time capsule letters) belongs to you. We do not claim any rights over it.

6. Third-party services

The App uses instant messaging SDKs, push notification services and crash reporting to provide core features. Your use of these features is also subject to the relevant third-party terms. See the 时光星达 Privacy Policy for details.

7. Disclaimer

To the maximum extent permitted by applicable law:

The App is provided “as is” and “as available”, without warranties of any kind, express or implied;
We are not liable for service interruptions or data loss caused by network conditions, device performance, iOS version or other factors;
You are solely responsible for the content you send through the App; we do not assume an obligation to review user-to-user content;
Local feature data is stored on your device; we are not liable for data loss caused by device failure or uninstallation.

8. Changes and termination of the service

We reserve the right, without notice, to:

Modify, suspend or discontinue any feature of the App;
Release new versions on the App Store or end maintenance of older versions;
Restrict or terminate your license if you violate these Terms.

9. Changes to these Terms

We may update these Terms from time to time. The updated Terms will take effect when we publish a new version of the App or post the changes on a page we designate, and the “Last updated” date at the top will be revised accordingly. Continued use of the App after a change means you accept the updated Terms. If you do not agree, you should stop using the App.

10. Governing law and disputes

The formation, validity, interpretation and enforcement of these Terms are governed by the laws of the People’s Republic of China (excluding the Hong Kong SAR, Macao SAR and Taiwan region). Any dispute should first be resolved through friendly negotiation; if that fails, either party may bring proceedings before the competent People’s Court at the developer’s place of residence.
